====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 22-08-2019 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 395 and 397 of the Indian Penal Code.

Submission is that the petitioner is not named in the FIR whereas some others are named. Petitioner is in custody since 10.01.2019. Investigation of the case is already complete against the petitioner. Petitioner was never put on T.I. Parade during investigation of the case nor any incriminating article was recovered from his possession. Some other co-accused have been allowed bail by a Coordinate Bench of this Court vide Anneuxre-2 and 3 of the bail petition.

Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of

Patna High Court CR. MISC. No.50304 of 2019(2) dt.22-08-2019 2/2 Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sessions Trial No. 196 of 2019 arising out of Mirganj Police Station Case No. 188 of 2018, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
