This is a petition for grant of regular bail for offences under Sections 307 and 379 of the Indian Penal Code and 27 of the Arms Act.
For business dispute, between the neighbours, the petitioner alleged fired from his pistol causing injury above the waist of the informant. The petitioner is in custody since 01.09.2016.
The learned counsel for the State opposed the prayer for bail on the ground that injury report is consistent with the prosecution allegation.
Considering the entire facts and circumstances, let the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten
Patna High Court Cr.Misc. No.8580 of 2017 (3) dt.28-03-2017 2/2 thousand) with two sureties of the like amount each in connection with Mahesh Khut P.S. Case No. 72 of 2016 to the satisfaction of the Additional Chief Judicial Magistrate, III, Khagaria, or successor Court after completion of nine months in custody.
