====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 17-02-2018 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Saur Bazar P.S. Case No.467 of 2016 registered under Sections 147, 148, 149, 447, 323, 307, 379, 504, 506 of the Indian Penal Code.

Learned counsel for the petitioners submits that the parties are fighting over a land dispute as they are own gotias. It is submitted that there is no specific allegation of assault against these two petitioners and the specific allegation is only against accused Abhinandan Yadav, Laltu Yadav and Dilip Yadav. The petitioners have got no criminal antecedent.

Patna High Court Cr.Misc. No.6929 of 2018 (2) dt.17-02-2018 2/2 Learned A.P.P. for the State is present.

In the facts and circumstances, as there is no specific allegation of assault against these petitioners, in case of their arrest/surrender before the court below within four weeks, let the above named petitioners, namely, Vikash Yadav and Bittu Yadav, be enlarged on bail on furnishing bail bonds of Rs.15,000/- (fifteen thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa, in connection with Sour Bazar (Patarghat O.P.) P.S. Case No.467 of 2016, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
