The petitioner has preferred this application for grant of regular bail in a case registered under sections 304B and 34 of the Indian Penal Code.
As per the prosecution case, the niece of the informant was married to the petitioner. She was tortured by the accused persons, assaulted and ultimately strangulated to death. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case only for the reason of his being the husband of the deceased. The allegations as levelled in the FIR are false and concocted. The petitioner is in custody since 22.1.2021 and has no criminal antecedent. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the contents of the postmortem report wherein besides the external injuries the cause of death is said to be strangulation leading asphyxia together with the petitioner being the husband of the deceased, the Court is not inclined to enlarge the petitioner on bail and the application is rejected.
