JUSTICE SANJAY KUMAR ORAL ORDER 15-02-2017 Heard learned counsel for the petitioner and learned APP appearing on behalf of the State.

The petitioner seeks regular bail in connection with Sursand P.S. Case No. 251 of 2015 registered for the offences punishable under Sections 363, 366(A), 372/34 of the Indian Penal Code.

The allegation is that the petitioner along with others allegedly abducted the daughter of the informant. Learned counsel for the petitioner submits that the victim in her statement given under Section 164 Cr. P.C. has not stated about any sexual assault by this petitioner. One of the co-accused Umesh Mandal has been allowed bail vide order dated 19.10.2016 in Criminal Miscellaneous No. 34858 of 2016 passed by another co-ordinate Bench of this Court. The case of

Patna High Court Cr.Misc. No.5886 of 2017 (2) dt.15-02-2017 2/2 this petitioner stands on similar footing and there is no antecedent also against the petitioner.

Learned APP for the State opposed the submission. Considering the nature of allegation and the case of this petitioner on similar footing, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Sub Divisional Judicial Magistrate, Pupri at Sitamarhi in connection with Sursand P.S. Case No. 251 of 2015.
