JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 2 12-01-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Pakaribarawan P.S. Case No. 129 of 2015 registered under Sections 341, 323, 324, 307 and 504 read with 34 of the Indian Penal Code.

It is contended that the informant is full brother of the husband of the petitioner. The occurrence took place on account of a trivial dispute. The injuries alleged to have been sustained by the informant and his wife are all simple and superficial in nature. It is further contended that the non-bailable

Patna High Court Cr.Misc. No.722 of 2016 (2) dt.12-01-2016 2 / 2 offences in the present case are Sections 324 and 307 of the Indian Penal Code. However, in the facts and circumstances of the case, the ingredients of offence punishable under Section 307 IPC would not be attracted.

On the other hand, learned counsel for the State has opposed the application for grant of anticipatory bail to the petitioner.

Be that as it may, regard being had to the facts and circumstances of the case, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Pakaribarawan P.S. Case No. 129 of 2015 subject to the conditions as laid down under Section 438(2) Cr. P.C.
