JUSTICE SANJAY PRIYA ORAL ORDER 30-03-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Banka P.S. Case No. 689 of 2016 instituted for the offence under Section 364/34 of the Indian Penal Code.

It is alleged that son of the informant has gone to place of relative with co-accused Rupesh Thakur. Rupesh Thakur returned alone who disclosed that Suraj will return within a day or two. But he did not return. The informant made search but he did not find his son. The informant suspected that co-accused Rupesh Thakur, Manju Devi and Prakash Thakur kidnapped him. It has been submitted that petitioner is not named in the written report. His name has come in the confessional statement of Soni Kumari.

The petitioner is in custody since 18.9.2016. Considering the aforesaid facts and circumstances, the prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Banka P.S. Case No. 689 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
