JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,341,323,325,337,338,307,353,504,506 and 120B of the Indian Penal Code and section 27 of the Arms Act. The prosecution case is that the mob obstructed the traffic on NH-57 as well as railway track, stopped Chitpur-Jogbani Express and they started pelting stones when the informant being Circle Officer, Forbesganj informed the Sub Divisional Officer, Forbesganj and reached on the spot then the stones were pelted as a result several police personnel received injuries. It is alleged against the petitioner that it transpired that the petitioner organized the mob to obstruct the railway traffic.
Patna High Court Cr.Misc. No.57176 of 2015 (2) dt.18-12-2015 2/2 It is submitted by the learned counsel for the petitioner that the accusation has been levelled against 11 FIR named and 400 unknown. The accusation is omnibus and general and only on suspicion the petitioners have been roped in the present case. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Araria in connection with Forbesganj (Simraha) P.S. Case No. 370 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
