The petitioner seeks bail in Srinagar P.S. Case No. 07 of 2017 registered for the offences punishable under Section 307 and some other Sections of the Indian Penal Code. The informant named the petitioner along with other accused persons and alleged that while his son Bikesh Kumar and brother Harihar Sah were cutting bamboos the petitioner and others came. The petitioner is alleged to have assaulted Bikesh Kumar, the son of the informant with Pharsa on his head. Learned counsel for the petitioner submits that only allegation against the petitioner is that the petitioner assaulted Bikesh Kumar with Pharsa on his head. Bikesh Kumar got simple injury on his head. Of course, Harihar Sah got grievous injuries
Patna High Court Cr.Misc. No.19642 of 2017 (3) dt.19-06-2017 2/2 but the petitioner is not author of that injuries. Considering the facts aforesaid the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate - II, Madhepura in Srinagar P.S.
