The petitioners being the parents and unmarried sisters of the husband of the victim are apprehending arrest in a case registered for the offences punishable under Section 304B/34 of the Indian Penal Code.
The prosecution case is of killing the sister of the informant within three years of marriage for non-fulfillment of dowry demand.
It is submitted by learned counsel for the petitioners that the victim was caused burn injuries on 01.08.2015, but the statement of the victim was recorded in P.M.C.H. on 08.05.2015 where she alleged that the accused persons caused burn injuries to
Patna High Court Cr.Misc. No.433 of 2016 (2) dt.08-01-2016 2/2 her.
Considering petitioner nos. 3 and 4 being unmarried girl, let them be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Siwan in connection with Maharajganj P.S. Case No.105/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
Considering the nature of accusation, let the learned Court below consider the prayer for regular bail of petitioner nos. 1 and 2, if they surrender within a period of six weeks in connection with Maharajganj P.S. Case No.105/2015, pending before the learned CJM, Siwan.
