The petitioner apprehends his arrest in Sadar P.S. Case No.471 of 2017 registered under Sections 363, 366(A) of the Indian Penal Code.

The informant alleged that while his granddaughter was going to school, Rajeev Kumar, the petitioner and others kidnapped his granddaughter.

The learned counsel for the petitioner submits that victim made her statement under Section 164 Cr.P.C. and she disclosed that she voluntarily left house and went along with Rajeev Kumar and solemnized marriage. She wanted to go to the house of her husband.

Patna High Court Cr.Misc. No.26156 of 2018 (2) dt.07-05-2018 Although, it appears that the victim is a minor girl but she herself denied her kidnapping.

Considering the facts aforesaid, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Sadar P.S. Case No.471 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Saurabh/- U T
