JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 504/34 of the Indian Penal Code and Section 25(1-B), 35 of the Arms Act. The prosecution case is that the son of the informant plucked Mango from the orchard of the petitioner when the petitioner and others brutally assaulted the son of the informant. It is also alleged that the petitioner was showing pistol in the air which was snatched by the villagers.

It is submitted by learned counsel for the petitioner that for a petty dispute the accusation has been levelled. Moreover, the arm was handed over to the police by the prosecution side, hence, it cannot be treated to be a recovery from the possession of the

Patna High Court Cr.Misc. No.56562 of 2015 (2) dt.14-12-2015 petitioner. A statement has been made in paragraph no. 3 that the petitioner has got no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahua P.S. Case No. 372 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
