====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 17-11-2021 Heard Mr. Vijay Kumar, learned counsel for the petitioner and Mr. Satyendra Prasad, learned Additional Public Prosecutor appearing for the State.
Petitioner seeks regular bail in connection with Chapra Town P.S. Case No. 678 of 2019 registered for the offences punishable under Sections 394, 307, 120(B) of the Indian Penal Code and Section 27 of the Arms Act. This is second attempt for grant of regular bail on behalf of the petitioner inasmuch as earlier the bail application of the petitioner was rejected by this Court vide order dated 25.3.2021 passed in Cr. Misc. 40130 of 2020 with liberty to renew his prayer for grant of regular bail after six months. The allegation as per the First Information Report is

No.64264 of 2021(2) dt.17-11-2021 2/3 that informant is the partner of Prasad and Sons Petrol Pump situated near Dakbanglow Road, Chapra, and on 11.11.2019 at about 12:50 PM, while an employee of the said Petrol Pump along with one relative of the informant, namely, Amit Ji, proceeded on a Scooty for depositing the sale proceeds of Rs.24,37,875/- in cash in the State Bank of India, Main Branch, Chapra, they were accosted by three miscreants riding on Apache Motorcycle who tried to snatch the bag from Amit Ji and upon protest, one of the miscreants fired bullet upon Amit Ji who sustained injury in his abdomen.
Learned counsel for the petitioner submits that while dismissing the bail application of the petitioner as withdrawn, this Court had given liberty to the petitioner to renew his prayer for bail after six months. Learned counsel further submits that the petitioner is not named in the First Information Report and his name has transpired on the basis of confessional statement of co-accused Manoj Kumar. He next submits that the registered owner of the Motorcycle whose Motorcycle was recovered from the place of occurrence has been granted bail by this Court in Cr. Misc. 2572 of 2021. The petitioner is in custody since 20.3.2020.
Regards being had to the submission made by the
Patna High Court CR. MISC. No.64264 of 2021(2) dt.17-11-2021 3/3 parties and taking into consideration the materials on record, the fact that the petitioner is in custody since 20.3.2020, co-accused has been granted bail by this Court and this is second attempt for grant of regular bail on behalf of the petitioner, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of Shri Chandra Boss Kumar Singh, learned Judicial Magistrate, Saran at Chapra, in connection with Chapra Town P.S. Case No. 678 of 2019.
It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines regarding social distancing.
