The petitioner apprehends his arrest in connection with Barahiya P.S. Case No.240 of 2021, registered for the offences punishable under Sections 8/20(b)(ii)(c)/29 of the NDPS Act.

Huge quantity of Ganja has been recovered from the houses of the accused persons.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is submitted that the petitioner has got five criminal antecedents as stated in paragraph-3 of the bail application. It is further submitted that the petitioner is not named in the FIR. The name of the petitioner has been surfaced in the case on the basis of confessional statement of the co-

Patna High Court CR. MISC. No.58391 of 2022(2) dt.22-12-2022 2/2 accused persons. It is also submitted that no contraband article has been recovered from conscious possession of the petitioner. Learned APP for the State opposed the prayer for anticipatory bail of the petitioner.

Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
