2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 341, 323, 337, 338, 427, 379, 354, 34 of the Indian Penal Code.
3. It is alleged that the petitioner along with other coaccused person come with arms and JCB machine and started destroying Rice Mill of informant and also assaulted him.
4. It is submitted by learned counsel for the petitioner that the petitioner is falsely been implicated in the present case and there is no criminal antecedent. There is a case and counter case between the parties. He has further submitted that other coaccused persons in the similarly situated case have been granted bail by the co-ordinate Bench of this Court in vide order dated 09.05.2023 and 12.05.2023 passed in Cr. Misc. No. 5245 of
Patna High Court CR. MISC. No.57149 of 2023(3) dt.11-10-2023 2/2 2023 and Cr. Misc. No.5929 of 2023, respectively.
5. Learned APP for the State opposes prayer for anticipatory bail.
6. Having regard to the facts and circumstances of the case as similarly situated co-accused persons have been granted bail, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned lower Court where the case is pending/successor Court in connection with Gaurichak P.S. Case No. 585 of 2022, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
