In this case, the petitioners are challenging the order taking cognizance dated 13.9.2012 passed by Chief Judicial Magistate, East Champaran, Motihari in Case No. O/C/56/12 whereby cognizance of the offences has been taken under Section 9, 48 and 49A of the Indian Forest (Protection of Wild Animals) Act, 1972.

The police recovered the skin of dear from the possession of one Ramkrit Mukhia and the petitioner has been made accused in this case. At this stage, this Court is not inclined

Patna High Court Cr.Misc. No.3418 of 2016 (2) dt.29-08-2016 to interfere with the order taking cognizance. The court below will look into the matter and pass order in accordance with law after examining the material available on record.

This application is, accordingly, dismissed.
