The Petitioner seeks bail in Piprahi P.S. Case No. 93 of 2016 instituted for the offence under Section(s) 30(a), 33, 36, 38 of the Bihar Prohibition and Excise Act, 2016. It has been submitted that petitioner is in custody since 23.11.2016 and the petitioner has fair antecedent. It is alleged in the written report that total 70 litres of Nepali liquor has been recovered from the tempo on which the petitioner along with two other accused were travelling. Keeping in view the period spent by the petitioner and the petitioner having clean antecedent, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above

Patna High Court Cr.Misc. No.8086 of 2017 (2) dt.07-03-2017 2/2 named, be released on bail on furnishing bail bond of 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheohar in connection with Piprahi P.S. Case No. 93 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.

It is made clear that in the event the criminal antecedent is found against the petitioner prior to grant of bail, learned Court below will be at liberty to take appropriate action for cancellation of bail bonds of the petitioner. (Sanjay Priya, J) Shageer/- U T
