2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 126(2), 115(2), 118(2), 109, 352, 351(2), 3(5) & 103(1) of the B.N.S. 3 . The prosecution case in brief, is that on the alleged date and time of occurrence , this petitioner along with others assaulted the uncle of the informant, namely, Ajay Bind by means of lathi, sword and knife with an intention to kill as a result Ajay Bind fell down. It is further alleged that when the informant, Nitesh and others came to rescue, they were also

4. It is submitted on behalf of the petitioners that petitioner is innocent and has committed no offence as alleged. Allegation against this petitioner is general and omnibus. No specific allegation of assault is alleged against this petitioner. From perusal of the order of the trial court it is clear that the cause of death of uncle of informant is due to shock as a result of head injury . Case and counter case . Petitioner claims clean antecedent. Similarly situated co-accused persons have already granted bail by this Court vide order dated 18.07.2025 in Cr. Misc. No. 43969 of 2025 .
5 . Learned counsel for the State opposed the bail petition .
6 Considering the aforesaid facts, clean antecedent of the petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-1st Class, Ara Bhojpur in connection with Shahpur P.S. Case No. 63 of 2025 , subject to the
Patna High Court CR. MISC. No.52975 of 2025(2) dt.20-08-2025 3/3 conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita , 2023 .
