ANJANA MISHRA ORAL ORDER 20-08-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Section 420 of the Indian Penal Code and Section 4/10 of the Bihar Conduct of Examination Act, 1981.

Learned counsel for the petitioner submits that in place of the petitioner Pappu Kumar, one Upendra Kumar was found writing the examinations. It is submitted that the present petitioner Pappu Kumar has nothing to do with the said Upendra Kumar who was caught red-handed appearing in the examination and has since been arrested. It is submitted that the petitioner had no knowledge about the said Upendra Kumar appearing in the said examination.

No.27457 of 2016 (3) dt.20-08-2016 P2/2 In view of the aforementioned submissions made by the petitioner and that the petitioner has got no criminal antecedent, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate Jehanabad in connection with Jehanabd P.S. Case No. 137/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
