The petitioner is accused in connection with Parsa P.S. Case No. 203 of 2016, registered under Sections 147, 148, 341, 323, 324, 307, 379 and 436 of the Indian Penal Code. The accusation is that 11 persons named in the F.I.R. including the petitioner armed with Dab, lathi and axe came near the husband of the informant. At that time, Ramji Singh caused injury at the head of the husband of the informant through Dav. Laxman Singh caused injury through Dav at the neck of the husband of the informant. Nitish Kumar also caused injury at the neck and back of the husband of the informant through rod whereas Pawan Kumar Singh also snatched the gold chain from the neck of the husband of the informant. Patna High Court Cr.Misc. No.13494 of 2017 (2) dt.24-03-2017 informant was caught hold by Babita Devi, Gyanti Devi, Asha Devi and Gudia Devi. Thereafter, Laxman Singh, Ramji Singh, Nitish Kumar and Alok Kumar sprinkled kerosene at the house of informant and tried to put fire.
Learned counsel for the petitioner submits that, in fact, due to land dispute, Case No. 516 of 2016 was instituted under Section 144 Cr.P.C., which was dropped on 16.09.2016, in which, police had submitted report about possession over the land in dispute of the petitioner saying that informant of the present case wants to capture the land. Moreover, injuries as found on the person of informant and her husband are simple in nature and the petitioner is in custody since 15.12.2016.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra, in connection with Parsa P.S.
