====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 07-08-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in connection with Sasaram Model Town P.S. Case No. 378 of 2025 dated 17.05.2025 registered for the offences punishable under Section 37 of the Bihar Prohibition and Excise (Amendment) Act, 2022 and Sections 25(1-B)(a) and 26 of the Arms Act.

As per the prosecution case, the petitioner and the other co-accused persons ridden on the motorcycle were apprehended in drunken condition and on search, one country made katta, two live cartridges and two mobiles were recovered from the possession of the petitioner whereas one mobile was recovered from the possession of the other co-accused person,

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is submitted that from perusal of the F.I.R., it appears that the other co-accused Antu Kumar was driving the motorcycle in question and the petitioner was sitting on the back seat of the motorcycle in question. No incriminating article was recovered from the possession of the petitioner. There is no statutory compliance of Section 103 of the B.N.S.S., 2023. The petitioner has no concern with the alleged offence. It is submitted that the other co-accused person, namely, Antu Kumar, has already been granted bail by a Bench of this Court in Cr. Misc. No. 41767 of 2025 vide order dated 07.07.2025. The petitioner has clean antecedent as stated in paragraph no. 3 of the bail petition. The petitioner is in custody in this case since 18.05.2025 whereas in the impugned order 18.04.2025 has been mentioned as stated in paragraph no. 10 of the bail petition.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond

No.54220 of 2025(2) dt.07-08-2025 3/3 of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise Court No. 2, Rohtas at Sasaram in connection with Sasaram Model Town P.S. Case No. 378 of 2025.

7. The application stands allowed.
