The petitioner is languishing in custody for the offence punishable under Sections 364A, 120B and 212 of the Indian Penal Code.

Petitioner is in custody since 13.11.2017. Name of the petitioner surfaced in the confessional statement of co-accused before the police while in police custody.

Submission is that in the past, prayer for bail was refused by order at Annexure-1 with liberty to renew prayer for bail if the trial is not concluded within six months. The report of the trial Judge dated 02.03.2020 would reveal that only 14 prosecution witnesses have been examined

Patna High Court CR. MISC. No.56782 of 2019(4) dt.19-02-2021 2/2 uptill now and 40 prosecution witnesses named in the charge sheet are still to be examined.

Considering the fact that there is no chance of conclusion of trial in near future as well as the fact that there is no need for further detention of the petitioner as under trial prisoner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with S. Tr. No. 103 of 2018 arising out of Nayagaon P.S. Case No. 111 of 2013, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
