The petitioner is apprehending his arrest in a case registered for the offence punishable under sections 379 and 411 of the Indian Penal Code.
Prosecution case is that a blue colour motor of the informant was stolen for the purpose of irrigation of field. On 24.4.2016 at 1.30 PM heap of straw of the petitioner caught fire. When the informant and other co-villagers came to extinguish fire, then the stolen motor of the informant was there inside the heap of the straw.
It is submitted by the learned counsel for the petitioner that only on suspicion the accusation has been levelled. Statement has been made in paragraph 3 of the application that the petitioner
Patna High Court Cr.Misc. No.25592 of 2016 (2) dt.27-06-2016 has no criminal antecedent.
Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Nagarnausa P.S.Case No. 51/2016 pending in the court of Smt. Rashmi Prasad, Munsif, Hilsa, District Nalanda. With the aforesaid observation, this application is disposed of.
