====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER --------- 18-03-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek bail in connection with Singheshwar P.S. Case No.249 of 2016 registered under Sections 379 and 411 of the Indian Penal Code.

The accusation is that on 25.12.2016, the informant had come at the Baba Temple, Singheshwar, to perform Puja. At the time of performing Puja, the purse of informant, in which there was Rs.1700/-, ATM card, College ID, Aadhar Card, Pan Card etc. of the informant, was snatched from his back pocket. When the informant turned back, he saw one lady coming out rapidly.

No.12198 of 2017 (2) dt.18-03-2017 2/3 Thereafter, the informant raised hulla on which the Manager of the temple apprehended that lady alongwith one another lady and one boy. On query, one lady disclosed her name as Navita (petitioner no.2) and on search, she was found in possession of Rs.420/- cash and the receipt of depositing Rs.45000-/ in the State Bank of India. The boy disclosed his name as Dilkhush Kumar (petitioner no.1) and another lady disclosed her name as Priyanka Kumari. Learned counsel appearing on behalf of the petitioners submits that in fact, the petitioner no.1 is the husband of the petitioner no.2 and they had gone to perform Puja in the temple but they were apprehended under misconception.

Further submission is that it would appear from the seizure list that from the possession of the petitioner no.1, Rs.4000/-, his Adhar Card and Adhar Card of one Kundan Kumar were recovered whereas from the possession of the petitioner no.2, Rs.420/- and the receipt, depositing Rs.45000/- in the State Bank of India, were recovered. The petitioners having no criminal antecedents are in custody since 26.12.2016.

Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction
