JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 27-04-2018 Heard learned counsel for the petitioner. Despite repeated calls, no body appears on behalf of the State. The petitioner seeks pre-arrest bail in connection with Barbigha P.S. Case No.139 of 2014 registered under Sections 420, 384, 406, 467 and 468 read with 34 of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that the petitioner has no concern with the business of the company of which co-accused Rakesh Ghosh and Mukesh Ghosh are Managing Director and Manager respectively. It was they who appointed the informant and handed over the appointment letter and obtained blank cheque as security. In the complaint it is specifically alleged that notice was sent to Rakesh Ghosh and

Patna High Court Cr.Misc. No.22293 of 2018 (2) dt.27-04-2018 2/2 Mukesh Ghosh for return of cheque and payment of remuneration. However, the petitioner is apprehending his arrest only because his name has also been given in the complaint as he was also an employee like the complainant in the company. Considering the nature of allegation and the submissions made above, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Sheikhpura in connection with Barbigha P.S. Case No.139 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
