The petitioner has filed the instant application for grant of regular bail in connection with Muffasil P.S. Case No. 99 of 2022 registered under sections 341, 323, 307, 504 and 34 of the Indian Penal Code and 25(1b)a/26/27 of Arms Act. Prosecution case relates to opening fire upon the informant by the petitioner along with co-accused, due to which the informant sustained injury.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He has falsely been implicated in this present case due to ill motive of the informant. During investigation no substantive evidence are

It is further submitted that from medical report which is annexed as Annexure-2 with this petition shows that injury is simple in nature and caused by hard and blunt substance which does not in consonance with the prosecution story. A statement has been made in para 3 of this petition that petitioner has got no criminal antecedent. He is languishing in judicial custody since 26.02.2022.

The application for bail is vehemently opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Muffasil P.S. Case No. 99 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Begusarai.
