JUSTICE RAVI RANJAN ORAL ORDER 18-01-2016 Heard learned counsel for the petitioner and the State. Petitioners apprehend their arrest in a case registered for the offences punishable under sections 47(A), 47(F)/13(F) of the Excise Act and sections 2(C)/3 of the Mahua Flower Act of the Indian Penal Code.
It is contended on behalf of the petitioners that neither they have been apprehended on the spot nor has anything been recovered from their possession. Allegedly, there is recovery of 50 litres of country made liquor made from Mahua and some utensils used for preparation of the same. It is submitted that the petitioners' antecedent is clean.
Having regard to the facts and circumstances of the case, let the abovenamed petitioners, namely, Dharo Chaudhary and Sudhir
Patna High Court Cr.Misc. No.1185 of 2016 (2) dt.18-01-2016 Chaudhary, be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Hisua Police Station Case No. 240/2015 on furnishing bail bonds of Rs.10,000/- ( Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of the C.J.M., Nawada, subject to the conditions laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
