JUSTICE BIRENDRA KUMAR ORAL ORDER 29-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is languishing in custody for the offences punishable under Sections 304B and 120B/34 of the Indian Penal Code.

There is general and omnibus allegation of demand of dowry and torture for the same against the petitioner also who is husband of the victim. The victim lady died within four years of her marriage in unnatural circumstances.

Submission is that co-accused Savitri Devi against her there was specific allegation of demand of dowry and torture for the same has already been allowed bail by a co-ordinate Bench of this Court vide Cr.Misc.No.37997 of 2016.

Patna High Court Cr.Misc. No.14391 of 2017 (2) dt.29-03-2017 Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Begusarai/Successor Court, in connection with Begusarai (Town) P.S. Case No.288 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
