The petitioner seeks bail in Sadar P. S. Case No. 417 of 2018 instituted for the offence under Section(s) 399, 402 and 414 of the Indian Penal Code and Section 25(1-b)a/26/35 of the Arms Act.
It is alleged in the written report that police got information that 8-10 persons have assembled near Banshwari near the house of Manish Thakur for committing crime. Police arrived at the place of occurrence and apprehended four persons as named in the written report.
It is alleged that three persons managed to run away including petitioner.
Patna High Court CR. MISC. No.50664 of 2019(2) dt.17-08-2019 2/2 Learned counsel for petitioner submits that there is no recovery of any incriminating article from possession of this petitioner. The name of this petitioner has come in the confessional statement of co- accused Mayank Kumar @ Monu who was arrested by the police from the spot. Petitioner is in custody since 22.11.2018.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the JM 1st Class, Muzaffarpur in connection with Sadar P. S. Case No. 417 of 2018 GR No. 3086 of 2018 subject to the condition that both the bailors shall be the close relative of the petitioner.
