JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 307, 379 and 504 of the Indian Penal Code.
The prosecution case is that the petitioner came to the house of the informant in drunken state and started abusing and on protest being made all the accused persons started assaulting the informant with lathi and danda when the father of the informant came to rescue he was also assaulted.
It is submitted by learned counsel for the petitioner that for the occurrence of 25.07.2015 at 8.30 AM the FIR was lodged on the same day at 10.10 PM but it reached to the court of learned Magistrate on 29.07.2015 which reflects that the FIR has been registered by antedating. At earlier point of time, petitioner's side
Patna High Court Cr.Misc. No.56974 of 2015 (2) dt.17-12-2015 2/2 lodged Nawada SC/ST P.S. Case No. 50 of 2015 against the informant's side and informant has received only one injury though, the father of the informant has received grievous injury. It is further submitted that similarly situated accused persons Agam Ram and others have been granted anticipatory bail by a coordinate Bench of this court vide Cr. Misc. No. 46146 of 2015. The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Roh P.S. Case No.58 of 2015 pending in the court of learned JM, 1st Class, Nawda.
Accordingly, the application is disposed of.
