Petitioner apprehends his arrest in a case filed under Sections 272 / 273 of the Indian Penal Code and Section 47 (A) of the Excise Act.

As per the allegation, a vehicle was intercepted and about 407 liters of foreign liquor was recovered from it and one Hira Lal Chouasia @ Matar Lal and the driver Md. Abdul Razzak were apprehended, who have disclosed the name of the petitioner. It is contended that the petitioner was not apprehended from the spot and nothing has been recovered from the conscious possession of the petitioner. Petitioner claims to be of clean antecedent and it is stated that this case having been filed

Patna High Court Cr.Misc. No.26387 of 2016 (2) dt.11-07-2016 2 / 2 on 17.03.2016 would be covered by the old law, i.e., before the amendment enforced on 04.04.2016.

Having regards to the facts and circumstances of the case, in the event of arrest/surrender within a period of six weeks from today in Forbesganj P.S. case no.126 of 2016, the above named petitioner, Pradip Bhagat shall be released on bail on furnishing bail bond of Rs.10,000( Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
