The petitioner is apprehending his arrest in connection with Case No.C2A-3 of 2018 (Bidupur P.s.) registered for offences punishable under Sections 20(b) and 8 (C ) of the NDPS Act. Allegation against the petitioner is of recovery of 370 kg. of Ganja from the semi-construction house of the petitioner. Submission of the learned counsel for the petitioner is that there is no recovery from the conscious possession of the petitioner and also the house does not belong to him. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant
Patna High Court Cr.Misc. No.24283 of 2018 (2) dt.03-05-2018 2/2 anticipatory bail to the petitioner rather let the petitioner surrender before the learned court below within a period of four weeks from the date of receipt of the order and make prayer for regular bail, which will be considered by the learned court below on its own merit.
