The petitioner has prayed for bail in connection with Begusarai Town (Ratanpur O.P.) P.S. Case. No. 726 of 2022 instituted for the offence under Sections 364, 120B and 34 of the Indian Penal Code and later on Sections 302 and 201 of the IPC were added.

Allegation against the petitioner along with other coaccused persons is that they abducted the husband of the informant and later on the dead body of the informant's husband was found from a bush.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this present case. The petitioner is not named in FIR rather his name came into light in this case during the course of investigation. A statement

Patna High Court CR. MISC. No.55266 of 2023(5) dt.03-01-2024 2/2 has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 7.12.2022.

Learned APP appearing for the state and learned counsel for the informant have opposed the prayer of regular bail and submitted that during investigation, petitioner arrested by the police and he confessed his guilt and at his instance, dead body of the informant's husband along with some incriminating articles have been recovered from a bush. As per postmortem report, doctor opined that the cause of death of the deceased is due to asphyxia as a result of strangulation. During investigation, witnesses supported the prosecution version. Having heard the learned counsel for the parties and considering the nature of allegation, this court is not inclined to enlarge the petitioner on bail and, as such, his prayer for bail stands rejected.

The trial court is directed to expedite the trial and conclude the same as soon as possible.
