1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Complaint Case No. 3444 of 2021, disclosing offences under Sections 323, 498(A) of the Indian Penal Code.
3. As per the prosecution case, the complainant's marriage with the petitioner was solemnized on 21.06.2018, in which about Rs. 19 lakhs were spent by her side, including cash transfers, jewellery, and other expenses. The accused no. 1 (husband), a Senior Officer in ICICI Bank, Hyderabad,
Patna High Court CR. MISC. No.55380 of 2025(2) dt.27-08-2025 2/3 allegedly demanded an additional Rs. 10 lakhs, and upon nonfulfilment, the complainant was subjected to cruelty and assault. It is further alleged that due to such harassment, her father passed away, and despite reconciliation efforts, she was ultimately ousted from her matrimonial home on 11.01.2021.

Learned Counsel for the petitioner submits that the petitioner, being the father-in-law of the complainant, has falsely been implicated in the present case and there is no direct allegation against him. He next submits that the petitioner's son had instituted Matrimonial (RCR) Case No. 59 of 2021 under Section 9 of the Hindu Marriage Act prior to the filing of the present complaint, wherein the complainant has been taking adjournments for filing written statement. The complainant has also filed Maintenance Case No. 2 of 2022, wherein in crossexamination, she denied to reside with the petitioner's son, and thereafter a joint petition for dissolution of marriage was filed with her consent.
5. Having regard to the submissions made on behalf of the parties and taking into consideration the fact that petitioner is father-in-law of the complainant, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.

7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Gopalganj, in connection with Complaint Case No. 3444 of 2021, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure/Section 482(2) of the BNSS, 2023.
