JUSTICE ARUN KUMAR ORAL ORDER 29-03-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner seeks bail in S.Tr. No.281 of 2016 arising out of C.A.Case No.1670 of 2001 registered under Section 376/34 of I.P.C.
Allegation against the three accused persons including the petitioner is of committing rape upon the complainant of this case.
An earlier regular bail petition of this petitioner was rejected by order dated 8.9.2016 passed in Cr.Misc.No.36060 of 2016.
Learned counsel appearing on behalf of the
Patna High Court Cr.Misc. No.15360 of 2017 (2) dt.29-03-2017 2/2 petitioner submits that fresh ground for filing regular bail petition in this case is that charge has been framed.
It appears that it is a case of the year 2001 and the petitioner absconded for a very long period and on that ground this Court is not inclined to grant bail to the petitioner, moreover, there is no fresh ground to reconsider the prayer for bail of the petitioner so the same is rejected.
However, trial court is directed to conclude the trial expeditiously.
