2. The petitioner apprehends his arrest in a case registered for the offence under Sections 137(2), 351(2), 87, 352, 3(5) of B.N.S., 2023.
3. As per F.I.R., this petitioner abducted the daughter of informant for the purpose of marriage.
4. Learned counsel for the petitioner submits that petitioner is quite innocent and has committed no offence. He further submits that husband of the informant's daughter died in Pune and thereafter, the daughter of informant had gone to Pune with this petitioner and brought dead-body of her husband at her house, but her family members handed over her to local police and later on, police, after going through the post-mortem report,
Patna High Court CR. MISC. No.54890 of 2025(3) dt.09-10-2025 2/2 released her. The statement of victim was also recorded under Section 183 B.N.S.S., in which, she has categorically stated that she went to Pune with this petitioner to bring the dead-body and thereafter, she remained with petitioner for three days and as such, the allegation of abduction is falsified. The victim is major. During medical examination, no sign of recent sexual assault was found and doctor has assessed the age of the victim, as 20 years. Petitioner claims clean antecedent.

Considering the statement of the victim recorded under Section 183 B.N.S.S. and clean antecedent of petitioner, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Araria in connection with Bairgachhia P.S. Case No. 47 of 2025, subject to condition as laid down under Section 482 of the B.N.S.S., 2023. (Prabhat Kumar Singh, J) anay U T
