JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 08-04-2016 Heard learned counsel, appearing on behalf of the petitioner, and the learned Addl. Public Prosecutor, appearing on behalf of the State as also learned counsel for the informant. This application for grant of anticipatory bail arises out of Complaint Case No. 1083/2014, disclosing offences under sections 323, 341, 307, 504, 506. 379/34 of the Indian Penal Code and section 3/4 of the Dowry Prohibition Act. The petitioner is husband of the complainant. Cognizance has been taken under section 498A of the Indian Penal Code and section 4 of the Dowry Prohibition Act.

Learned counsel for the petitioner submits that the

Patna High Court Cr.Misc. No.58174 of 2015 (3) dt.08-04-2016 petitioner is ready to keep the complainant with all love and dignity.

However, considering the fact that the present application arises out of a complaint case, the petitioner is directed to appear before the court below within four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered in terms of the decision of this Court in the case of Salim Ansari @ Md. Salim Ansari & ors., v. the State of Bihar & anor., reported in 2015(3) PLJR 806 and disposed of on the same day.

This application for anticipatory bail is, hereby, rejected, but with the aforesaid observations.
