The petitioners seek anticipatory bail in connection with Konch P.S.Case No. 20/2018, GR. No. 569/2018, registered for offences punishable under Sections 354, 376 and 511 of the Indian Penal Code.
The allegation as per written report by the informant is that the petitioner, on the pretext of getting pass to the daughter of the informant in the matriculation examination, started talking with her on mobile and ultimately the petitioner tried to outrage modesty of the victim girl. Submission of the learned counsel for the petitioner is that the victim girl is major and the case against the petitioner is not under POSCO Act and the petitioner has falsely been implicated in this case and the petitioner has no criminal antecedent.
Learned A.P.P. opposed the prayer for bail.
Having heard both sides and in view of the facts and
Patna High Court Cr.Misc. No.19631 of 2018(2) dt.12-04-2018 2/2 circumstances as discussed above, let the petitioner, in the event of his arrest or surrender before the court below within a period of six weeks from the date of order, be released on bail on furnishing bail bond of Rs. 25,000/- ( Twenty five Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-1st -Cum Special Judge ( POSCO) Act, Gaya, subject to the condition that as laid down under Section 438 (2) of the Code of Criminal procedure.
With following conditions:- i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
ii) The petitioner will not induce any witness or tamper with the evidence.
iii)The petitioner shall co-operate in the investigation of the case and make themselves available as and when required by the Police, otherwise, the prosecution is free to move for cancellation of his bail bond.
