The petitioner seeks bail in Pakri Dayal P.S. Case No. 109/2016, registered for the offences punishable under Sections 392 and 448 of the Indian Penal Code and Sections 25(1-b)A and 26 of the Arms Act.

The informant alleged that the petitioner came to him on 04.08.2016 and snatched Rs. 1,000/- from his pocket. The informant did not inform the police, but again on 10.08.2016 the petitioner came and pointed out pistol at the temple of his wife but his wife raised alarm. The villagers caught the petitioner and handed him over to the police.

Learned counsel for the petitioner submits that entire

Patna High Court Cr.Misc. No.11168 of 2017 (2) dt.10-03-2017 2/2 allegation is false and concocted. On account of some petty dispute, the petitioner has falsely been implicated in the case and the recovery of country made pistol without cartridge was transplanted and showed to have been recovered from possession of the petitioner. The petitioner is in jail since 11.08.2016 for recovery of country made pistol without cartridge. Considering the facts aforesaid and the fact that the petitioner has already remained in jail for more than six months, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Pakri Dayal P.S.
