The petitioner apprehends his arrest in Motihari Town P.S. Case No.423 of 2018 registered under Sections 420, 468, 471, 472, 120B and 34 of the Indian Penal Code. The gist of the allegation is that the son of the petitioner produced a birth certificate on which some overwriting was done. The son of the petitioner disclosed that his father handed over the certificate to him, on such, the petitioner has been made accused in the case. The learned counsel for the petitioner submits that petitioner has not made any interpolation or overwriting on the birth certificate of his son. The son of the petitioner who was accused in a case registered under different Sections of the I.P.C.
Patna High Court CR. MISC. No.50673 of 2019(2) dt.14-08-2019 2/2 produced the certificate in Court for declaring him to be juvenile and he disclosed the name of the petitioner but there is nothing on record to show that it was petitioner who made overwriting on the birth certificate.
Taking into consideration the facts aforesaid and nature of allegation made against the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Motihari Town P.S. Case No.423 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
