Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 306 of the Indian Penal Code.

The prosecution case is that the informant was residing in a rented house with his family members and his wife Lalita Devi. The wife of the informant Lalita Devi took a loan of Rs.45,000/- from petitioner. Petitioner demanded back the money and used to misbehave with informant's wife. On 09.10.2015 at about 10.00 A.M. the petitioner entered into the room of the informant, demanded the alleged amount, created nuisance, insulted and abused her and forcibly took away Rs.45,000/- which she had got from Committee, as a result she felt inserted and committed suicide by hanging

It is submitted by the learned counsel for the petitioner that Inquest Report was prepared at 2.00 P.M. on 09.10.2015, but subsequently the First Information Report was registered at the behest of the husband of the victim on 09.10.2015 at 4.30 P.M. He further submits that even assuming the accusation, the act of the petitioner does not come within the purview of abatement to commit suicide. The aforesaid facts constitute ground for consideration of prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Kadamkuan P.S. Case No. 504 of 2015, pending in the court of learned J.M., Ist Class, Patna.

With this observation this application is disposed of.
