This application for grant of anticipatory bail arises out of Hazipur Sadar P.S.Case No. 132/2015, disclosing offences under sections 147, 148, 149, 452, 504, 506, 364, 427, 380, 307, 302, 324 and 326 of the Indian penal Code.
The petitioner is an accused in a case under section 302 of the Indian Penal Code. I am not inclined to grant him privilege of anticipatory bail in view of the Supreme Court decision in the case of Jai Prakash Singh v. the State of Bihar & anr., reported in (2012)4 SCC 379.
This application is, accordingly, rejected.
Patna High Court Cr.Misc. No.56852 of 2015 (2) dt.26-02-2016 The petitioner is directed to surrender before the court below within four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered on its own merit, without being prejudiced by rejection of present application for grant of anticipatory bail.
