The petitioner seeks bail in connection with Pauthu P.S. Case No. 20 of 2017 registered for the offences punishable under Sections 379, 411/34 of the Indian Penal Code. Allegedly, the petitioner was caught driving the stolen tractor of the informant and further the petitioner confessed his guilt.

Submission is of false implication and that the petitioner was looking after the cultivation work of the informant and he was not given his salary for last several years and for that he has been falsely implicated in false story in theft of tractor, the petitioner was not found along with the tractor, he has got no criminal antecedent, he is suffering in custody since 17.02.2017 and as such he deserves sympathetic consideration.

Patna High Court Cr.Misc. No.19438 of 2017 (2) dt.24-05-2017 Learned APP opposes the prayer of bail.

In the facts and circumstances stated above, considering the alleged recovery of stolen tractor from possession of the petitioner, this Court is not inclined to enlarge the petitioner on bail, accordingly, his such prayer stands rejected. However, the petitioner may be at liberty to renew his prayer of bail after remaining six months in custody. (Jitendra Mohan Sharma, J) avin/- U T
