Petitioner is apprehending arrest in connection with Dhoraiya P.S. Case No. 191 of 2016 for an offence under section 409 of the Indian Penal Code.
The allegation against this petitioner is that he has not submitted the relevant record (Annexure-2) for verification of the original record including the merit list for appointment of the Panchayat Shishak.
Learned counsel for the petitioner submits that in fact all the relevant documents were submitted by the petitioner in connection with investigation by the vigilance and as such the petitioner in the present case is innocent and not in any manner connected with commission of crime.
Patna High Court Cr.Misc. No.5685 of 2018(3) dt.27-02-2018 2/2 Learned counsel for the State admits that the petitioner has submitted all the relevant documents.
In view of the above, considering the fact that the petitioner has no criminal antecedent as per averment made in para-3 of the petition, this court is inclined to grant bail to the petitioner named above, in the event of arrest/surrender before the court below within a period of one month from the date of receipt/production of a copy of this order on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Banka, in connection with Dhoraiya P.S. Case No. 191 of 2016 subject to the condition as laid down under section 438(2) of the Cr.P.C.
