JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 21-06-2017 Heard learned counsel for the petitioner, learned counsel appearing on behalf of O.P.No.2 and the learned A.P.P. for the State. The petitioner apprehends his arrest in connection with Complaint Case no. 416 of 2015 / 391 of 2015, registered under Sections 420 and 423 of the Indian Penal Code. Learned counsel for the petitioner submits that the matter was referred to the Mediation Centre, Patna High Court for settlement of the dispute between the parties and disputes has been settled with the help of mediation in terms of the agreement as attached with the report of Mediator dated 22.05.2017. Accordingly, Rs. 10,50,000/- was decided to be paid by the petitioner to O.P. No.2. It is further reported that Rs. 1,50,000/- has already been paid to the O.P. No.2 by the petitioner and rest amount of Rs. 9,00,000/- is to be paid by the

Patna High Court Cr.Misc. No.49873 of 2016 (3) dt.21-06-2017 2/2 petitioner in 36 equal amount of Rs. 25,000/- or three months and quarterly. The report of Mediation Centre, Patna High Court is kept on record along with Memorandum of Agreement entered in between the petitioner and the O.P. No.2.

Having regard to the facts and circumstances of the case and also to the fact that dispute has been settled in terms of the Memorandum of Agreement attached with the Mediator report dated 22.05.2017, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Madhubani in connection with Complaint Case No. 416 of 2015 / 391 of 2015, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
