The petitioners apprehend their arrest in Chandradip P.S. case No. 117 of 2017 under Section 337, 353 and some other Sections of the Indian Penal Code.

The informant alleged that he arrested one Sandip Yadav, accused of Chandradip P.S. case No. 114 of 2017, and brought him to the police station but Baldeo Yadav and others, including the petitioners, came to the police station and begun to abuse the police officers. They started pelting bricks. The learned counsel for the petitioners submits that

Patna High Court Cr.Misc. No.8307 of 2018 (2) dt.17-02-2018 2/2 petitioners were not members of mob and they have falsely been implicated in the case. Nobody was injured. It is a case of highhandiness of the police. There is no specific allegation against the petitioners.

Considering the facts aforesaid and the nature of allegation made against the petitioners, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri N. K. Yadav, learned Judicial Magistrate, 1st class, Jamui in connection with Chandradip P.S. case No. 117 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
