JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 02-02-2023 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner has filed the instant application for grant of regular bail in connection with Kamtaul P.S. Case No. 78 of 2022 registered under Sections 302, 120(B), 341, 323, 379, 504, 506 and 34 of the Indian Penal Code. Prosecution in short is that while the brother of the informant was going to his shop with Rs. 1,10,000/- along with licensee pistol, in the meantime, accused persons including petitioner assaulted him due to which he sustained injury and in the way for treatment he died. It is further alleged that one of the accused snatched the said amount from him.

Learned counsel for the petitioner submits that petitioner submits that petitioner is innocent and has committed

Patna High Court CR. MISC. No.56303 of 2022(3) dt.02-02-2023 2/2 no offence. She has falsely been implicated in this present case due to local politics and previous enmity. Petitioner is a lady and general and omnibus allegation levelled against her. It is further submitted that there is a case and counter case between the parties. The specific allegation of assault is against other co-accused not against this petitioner. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. She is languishing in judicial custody since 11.04.2022.

The application for bail is vehemently opposed by learned APP for the State and learned counsel for the informant. Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Kamtaul P.S. Case No. 78 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Trial Court of Sessions Judge, Darbhanga.
