JUSTICE SANJAY PRIYA ORAL ORDER 13-02-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offence under Sections 41, 399, 402 of the Indian Penal Code read with Sections 25(1-b) a, 26 and 35 of the Arms Act. It has been submitted that the petitioner was not caught on the spot. Seven persons are alleged to have been caught on the spot. Out of them, one person namely, Saddam Ali disclosed the name of the petitioner. It has further been submitted that one of the co-accused who was apprehended on the spot, has been granted bail by a coordinate Bench of this Court vide order dated 19.12.2016 passed in Cr. Misc. 52815 of 2016. From the impugned order, it appears that the petitioner is in custody since 3.12.2016.

No.4493 of 2017 (2) dt.13-02-2017 2/2 Considering the aforesaid facts and circumstances of the case, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj, in connection with Thawe P.S. Case No. 121 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
