JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 457, 341, 323, 354B and 504/34 of the Indian Penal Code.

The prosecution case is that on 31.08.2015, the petitioner entered into the house of the informant and attempted to outrage the modesty of the informant and when she raised alarm the petitioner escaped from the scene and thereafter the petitioner, his father and other accused assaulted the daughter of the informant.

It is submitted by learned counsel for the petitioner that for the occurrence of 31.08.2015, the FIR was lodged on 04.09.2015 and there was a dispute between the parties from before. A statement has been made in para 3 of the petition that

Considering the delayed lodging of the case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., West Champaran, Bettiah in connection with Bairiya P.S. Case No. 232 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ranjan/- U T
