JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 22-09-2015 The petitioner is a PDS licensee having License no. 94 of 2007. He prays for quashing of the order dated 28.6.2011 issued by the Block Development Officer, Jandaha, Vaishali, whereby a sum of Rs. 25163/- has been demanded against the value of undistributed rice allotted to him under the Government scheme.

The petitioner by referring to counter affidavit submits that he has already deposited Rs.50,000/- vide receipt dated 4.8.2011. It further appears that the District Certificate officer, Vaishali has initiated Certificate case no. 78 of 2011-12. Having regard to the facts of the case, it is observed as follows:- The petitioner would deposit an additional sum of Rs.10,000/- besides the sum of Rs. 50,000/- already deposited on 4.8.2011 vide NR no. 830346.

Patna High Court CWJC No.18386 of 2013 (3) dt.22-09-2015 2/2 No coercive steps would be taken against the petitioner if the said amount is deposited within two months. The certificate officer would proceed to consider the matter in accordance with law. It would be open for the petitioner to file his objections.
